Documents Required for Trademark Registration in India
What to keep ready before filing TM-A — logo file specs, user-affidavit rules for prior use, and the MSME/startup proof that halves the government fee.

A trademark application (Form TM-A) is filed per class. Once filed you get the application number the same day and can legally use the ™ symbol — but the ® symbol only after registration.
Form TM-48, the Power of Attorney, authorises Jurisync's professional to prosecute the application on your behalf. It must be signed by the proprietor, partner or authorised director.
If you have been using the mark before filing, claiming the earlier user date strengthens your rights in an opposition — but you must back it with a notarised user affidavit and dated proof such as invoices, packaging or advertisements.
Small entities should upload the Udyam Registration Certificate or DPIIT startup recognition at the time of filing. Uploading it later does not get you a refund of the higher fee already paid.

Mandatory documents

- Applicant details: name, address, nationality, entity type
- PAN and Aadhaar of the applicant (individual or proprietor)
- Signed Form TM-48 (Power of Attorney)
- List of goods or services with the intended class
For companies, LLPs and firms
- Certificate of Incorporation or partnership deed
- PAN of the entity
- Authorisation of the signing director or partner
Optional but valuable
- Udyam (MSME) certificate or DPIIT startup certificate for reduced fee
- User affidavit if claiming use prior to the filing date
- Invoices, packaging, brochures or ad proof supporting the claimed user date
